My girlfriend had a small crash the other day with another driver. Exchanged details etc and went there seperate ways.

She then rang the insurance the following day, they came and took the car away and left her with a courtesy car. Then she starts to worry that the car tax has run out. Turns out it did on the 1st of this month, as well as that it also hasn't had its MOT but was serviced about a month ago at the dealer.

Yes i know she is stupid and in her words, "i thought it ran out next month".

So what happens now? Is her insurance still valid? Is she in big trouble?

She hasn't heard from her insurnace since they took her car.

Car is insured regardless of tax or MOT status, however the DVLA have probably already sent you a fine in the post. If they haven't (because they're incompent) then consider yourself lucky, get it taxed because if you do it now you end up paying for the whole of the month anyway.

Policy is valid ONLY IF all other driving conditions (License, Road Tax, MOT ....) are met, no?

No.

The insurer are still liable for 3rd party claims, even if their insured is banned from driving, drunk, high and the car has no tax, MOT or brake hoses.
