I know what you're getting at but again even that stops short of clearly stating the driver passed out whilst driving. Usually this is quite intentional

I'm not trying to defend anyone or the system that potentially let an unfit person drive, but there is a distinctly nasty element to mainstream media at the moment that likes to fill in the blanks for people.

Just need to wait for the full picture and result of the FAI I guess

Dvla don't care if it's whilst driving. A single epileptic fit will see you banned from driving for a couple of years.
He lied to the dvla and to the medical and should see a court room.

My understanding was that one fit doesn't signify epilepsy, the second one does.
Then it is a case of medication, or control, and an elapsed period of time before you can hold a valid licence again.

If he lied... Hmm. Let's wait and see.

Surprised the police haven't taken this further to be honest.

I'm sure they will.

Had he declared this, he'd have had his HGV licence most likely cancelled or restricted at least and above all he'd not have been at the wheel when this awful event happened.

If this is true, which he appears to have admitted to it, I hope they throw the book at him.

He lied on his job application, had he not done so, those six who died would still be here.

There has already been a decision by the procurator fiscal that there will be no criminal charges. However I'm not sure how final that is.

In light of today's revelation, I'm sure that decision will be reviewed.


These medical questions for Hgv drivers are for a good reason, I've been subject to it myself in the past.

How awful for the victims relatives though, to know what previously was viewed as a tragic accident should and could have been avoided but for the selfish actions of the driver.

My previous sympathy and empathy for him has evaporated entirely.

he lied because he knew if he told the truth he would not be allowed to drive because this may happen.

it happened he really should face prosecution, the lies show he knew full well the risks.

Interestingly, in the above it says:

“In order to bring a criminal prosecution, the Crown would need to prove the driver knew that to drive on the day of the incident was to do so in the face of a known and obvious danger – that he was liable to lose consciousness while driving that morning.

“Following consideration of all the evidence, Crown Counsel has concluded that the Crown cannot prove this and as a result has instructed no proceedings.

“Crown Counsel recognises this will be disappointing and upsetting to the girls’ families.

“However, this is a legal decision and was inevitable following the insufficiency of evidence."

Surely they could have a go at making the case?

Can't believe he's thought he can simply just go out and drive... really need to consider jailing him now surely.

Here one from a few years ago in Guernsey where the driver suffered from Epileptic fits and killed a young motorcyclist..

The driver of the Toyota will not face criminal proceedings but her licence has been revoked.

I can never understand how people with these kind of medical conditions where allowed to drive cars & lorrys etc :confused:
