Redundancy - Getting another employer in HELP

Hi

If someone is made compulsory redundant and was told this was because there department was closing then can the employer get another company in to do the job even though the department is actually not being made redundant. Please advice?

The role has been made redundant as they are sub contracting the function out to another company, so yes it is legitimate as that role no longer exists within the company.

Only if the old employees transfer to the new employer/provider. There no requirement to transfer though.

@op I assume they've followed all the proper procedures such as consultation period etc? What is your union saying about it?
