Longer answer - RMA the card, brook no BS about the card not being faulty, eventually you will get a later revision version that works. But it may take two or three goes.

I believe it is standard three years. HOWEVER, Gainward will only address warranty issues if you purchased the card direct from their online store. If it was purchased from a retailer, their new warranty terms stipulate that it is the retailer's responsibility to make good on any problems...

An update - just loaded up Quake 4, first game I've tried with my new BFG 7900GTX OC.
*Immediate* result: tearing, artifacts, weird flickering. Quitting the game prompted the classic 'screen flicking on and off' scenario, coupled with desktop corruption and degraded system responsiveness...
Don't you need a SLI mobo for these to work, even though they are a single slot design? Something to do with the mobos ability to split the PCI-E bus...
7800GTX is an underwhelming step up from a 6800, especially in games with HDR... 7900GTX much better, but there are many dodgy ones around.
I would like to think resellers in general have come to recognise this is not a 'normal' problem that can be exposed by tried and trusted methods, and so are now testing the cards more rigorously.
Have faith, RMA it (you don't have any other choice), and if not satisfied pursue your complaint...
