I have a new Hitachi 164Gb hd that im trying to do a clean install of xp to in a 2nd pc but i keep getting the error 'Setup was unable to format this partition blah blah blah'

I have tried different cd's, cd-roms, dvd, ram, with no difference

Then i put a different hd in it and get a succesfull format and install?

    Any ideas,

Fine as in "managed to install XP on it" ? Thing is, a disk error (bad block) is not allowed in the boot sector if you are installing the OS on it - but for other uses it can be OK. Get a diagnostic program from the manufacturers and run it.
