GIGABYTE™ Super Care Card – Terms & conditions
GIGABYTE™ provides with the Super Care Card (hereinafter called "Card"), an additional voluntary service that can be used in conjunction with the purchase of one of the approved products by the registered owner of the card.
The service of the card is accessible for each end user (hereinafter called “buyer”), who has purchased a GIGABYTE™ motherboard of the Intel® 100 chipset series in accordance with the chipset list* or the GIGABYTE™ X150/X170 series (hereinafter called "product") and in addition one of the variants* of the Card and has registered both.
GIGABYTE™ provides after a successful registration each buyer of a purchased product and the Card the opportunity,
In case of warranty, to claim the services directly from the manufacturer,
To use an extended warranty up to 3, 4 or 5 years. (Depending on the variant* of the Card),
To get refunded a loyalty bonus after the registration of a successor product of the 100-series within the extended warranty period of the Card.
The buyer must register his newly purchased GIGABYTE™ product together with the Card within six months from the date of purchase at http://G1.GIGABYTE.eu/.
During the registration the buyer must submit to GIGABYTE™ a receipt or a copy of it as evidence of the purchase date of the product.
During the registration the buyer must submit to GIGABYTE™ the serial number of the product either based on the invoice or based on a picture.
During the registration the buyer must submit to GIGABYTE ™ the activation code of the Card.
The purchase of the approved product for this promotion must be made from a trading partner of one of the approved countries (*list of countries).
In case that the customer bought the Card later than the product, so both, the card and the product must be registered within at least 6 months after the purchase date of the product.
After complete and successful registration and the explicit confirmation from GIGABYTE™, the buyer acquires the right to use the promised services.
GIGABYTE™ is authorized under the following conditions to exclude the buyer without notice from taking part in this promotion:
Attempts at manipulation with respect to the registration
In case of multiple registrations of a serial number
If the deadline for the registration of data has been exceeded
For culpable violations of other fundamental obligations under these conditions
After a successful registration of the product and the Card the buyer gets granted a special right to claim all warranty issues with the manufacturer directly. For this purpose the buyer has to inform the manufacturer about the warranty case and to send the defective product together with a copy of the Card at his own expense to the nearest service centre (for Germany, Austria, Switzerland, this is Hamburg; for UK: Milton Keynes; for Nordics: Malmö, for BeNeLux: Eindhoven). The processing is performed in the service centre with the highest priority. The manufacturer is free in his decision to repair the product or to exchange the product for at least an equivalent product. After the repair, the repaired / exchanged product will be returned back to the buyer at the expense of the manufacturer. Should the buyer be resident outside the defined list of countries, the buyer bears the cost of both transport routes. The time period in which the services can be claimed, depends on the value of the card and is included in the list of services*.
Express-replacement-service with preliminary-exchange-option:
If, during the registration of the Card, there has been an agreed upon express exchange service with the buyer for direct service additionally, the replacement product will be exchanged and returned as soon as possible after arrival of the defective product from the buyer. If the buyer requires the use of an advanced replacement option, he has to specify this during the registration process, which is accompanied by the consent for a direct debit (SEPA) mandate. By using the advanced replacement services, the manufacturer will send the replacement product one working day after the warranty claim was announced together with a return slip and a pro forma invoice. The buyer must return his defective product back to the service centre by using the paid by GIGABYTE™ retour label within 14 days, based on the date of the pro forma invoice. If the buyer has not returned the defective product within the specified period, the manufacturer is entitled to collect the amount of the pro forma invoice from the buyer's bank account. For this purpose, the buyer has consented with the manufacturer in advance to a direct debit agreement .
If the buyer purchases an equivalent successor product within the acquired extended warranty period, GIGABYTE™ refunds the purchase price of the Card in the form of a loyalty bonus of 100%, if the price of the successor product is not less than the printed value on the Card. If the successor product is cheaper than the purchase price of the Card, so this lower value will be paid out as a loyalty bonus represented as the top limit. The successor product must be from a higher chipset series than the registered product and has to be at least a feature equivalent. To apply for the loyalty bonus, the buyer must present the card to GIGABYTE™ in original form. After the loyalty bonus has been paid out, the agreement for the special services is terminated and GIGABYTE™ is free from any claims arising from this agreement. It’s up to the buyer to buy a new card to use the services for the new product again. After the expiration of the extended warranty period, the right to claim the loyalty bonus has expired, also and cannot be redeemed anymore.
Case of warranty:
GIGABYTE™ guarantees that the registered product is free from defects and errors that are caused by the production or the appropriate use. Excluded from the warranty are products that have been altered or for which the serial number has been altered or removed, damages or malfunctions that are particularly due to: Acts of God, incorrect or improper installation or use, damages of any kind, improper repairs or attempted repairs by unauthorized persons as well as damage caused by third party products. If, in the case of warranty the product will be replaced by another product, the buyer can return the Card. GIGABYTE™ will reimburse the fair value of the card to the buyer. The fair value is determined by the expiry of the warranty period in relation to the promised extended warranty period (by list of services*).
Each buyer has to ensure for the accuracy of the provided data. The provided personal data of the buyer, collected during the registration will be stored and used exclusively by GIGABYTE™, to perform the services. A transfer of the buyer’s personal data to third parties will happen only insofar as these are necessary to perform the GIGABYTE™-service. A transfer to other third parties for advertising purposes is strictly excluded. After the registration, each buyer will be notified in writing by email and agrees to an optionally possible publication of his name. Any liability of GIGABYTE™ in connection with the settlement of the services is excluded. If the implementation of this settlement is, for objective reasons not possible or would involve unreasonable inconvenience, this can be adjusted without further reasons. GIGABYTE™ reserves the right to change these terms at any time and/or supplement. The decision is final. The law of the Federal Republic of Germany shall apply. Should any of these conditions be invalid, the validity of the remaining provisions shall remain unaffected.
